Mediation is a non-determinative process of facilitated discussion and negotiation.
Parties in dispute engage a mediator, an independent third party, to facilitate communication and assist the parties in reaching a mutually agreeable solution.
Mediation offers many benefits including being voluntary, confidential, efficient and flexible. It is a non-determinative process in the sense that rather than being bound by the decision of a judge or arbitrator, resolution of the dispute is reached by agreement of the parties.
Mediation also provides parties with the opportunity of focussing on their subjective needs and interests as opposed to being restricted to arguing about their objective “legal” rights, as is the case in litigation or arbitration.
Our Alternative Dispute Resolution (ADR) team have experience in all forms of ADR and can provide assistance and advice on all ADR related matters.
They also regularly act as mediators in a variety of fields including construction disputes, general civil litigation matters, leasing disputes, landlord and tenant disputes and workplace disputes.
