Demerit PointsThe holder of a South Australian Driver's licence will have their licence disqualified if they accrue 12 demerit points within a 3 year period (different provisions apply to the holder's of Learner/ Provisional and Probationary Licences).
If you receive an expiation notice for a traffic offence and you are unsure about how many demerit points you will incur as a result of an expiation notice, you should contact a lawyer before you pay the expiation notice and before the expiation notice is due. Before the expiation notice expires, if you consult a lawyer, the lawyer can apply for a reduction in demerit points in many circumstances (including a reduction to zero demerit points in some circumstances). Once an expiation notice has been paid, you can no longer apply for a reduction in demerit points. You may also not be aware that you may incur demerits points for the following: Committing traffic offences interstate (where a corresponding law applies); Drink Driving (even where you have already received a penalty, such as a fine/ disqualification, from a Court in relation to that offence); and Failing to ensure passengers are wearing a seatbelt or approved child restraint.
