What is a Will?
A Will is a legal document allows you to choose who receives your estate after you die. It can also be used to appoint a guardian to look after any of your children until they are able to look after themselves.
What is an Estate?
An estate is the total of all your assets including, but not limited to, your home, other properties, belongings, contents of bank accounts and all other items belonging to you.
How does a Will help me?
If you die without a Will then the Government has rules which apply to how your estate is distributed. For example, this could mean that your house may need to be sold even if your partner is living in it to provide for a distribution to a child from a former relationship. It is very important that you always have a well prepared and up to date Will.
What is an Enduring Power of Attorney?
An Enduring Power of Attorney is a legal document which gives a person you choose the power to manage your financial affairs while you are alive. Signing a Power of Attorney will allow someone you trust to act on your behalf in your absence or if you become incapacitated. The authority to act on your behalf will not end if you become mentally or physically incapable of managing your own affairs. You should think carefully about your choice of Attorney as this is the person who will look after your financial affairs. It should be someone you know and trust.
What is an Enduring Power of Guardianship?
An Enduring Power of Guardianship is a legal document which gives a person you choose, the power to make decisions on your behalf that affect your lifestyle and medical treatment should you become mentally incapacitated. An Enduring Power of Attorney can be used on any occasion that you become incapacitated due to illness, accident or other events and you lose your ability to make decisions. You should think carefully about your choice of Attorney as this is the person who will be responsible for the decisions made about your medical treatment and your lifestyle requirements whilst you are incapacitated.
What services does Camatta Lempens offer in this area?
Some Wills are reasonably straight forward and others involve significant advice and drafting before the Will is finalised. For these reasons, it is not possible to advise exact costs for such services. However, at Camatta Lempens, we are committed to providing a superior service and product at a very competitive price. In some cases, the size and nature of your assets may mean that the document requires extensive and complex drafting which can take up a considerable amount of time. You should bear in mind that attention to detail and time spent now can result in avoiding unnecessary costs later. Well drafted and executed documents can significantly inhibit the ability of others to contest the contents of those documents. We are also able to advise on and draft family trusts or company and unit trusts. In these circumstances, the estimated cost of this service will be conveyed to you prior to any 'billed' work commencing. We will discuss your particular circumstances with you before we proceed with any drafting and final preparation of your Will, Enduring Power of Attorney or Enduring Power of Guardianship.
